This Refund Policy explains the refund and cancellation practices applicable to paid subscriptions for PeopleEvo, a software-as-a-service platform provided by NyxDay Inc. ("PeopleEvo," "NyxDay," "we," "us," or "our").
This Refund Policy should be read together with the PeopleEvo Terms and Conditions, applicable subscription information, and any commercial terms presented at the time of purchase.
1. General Refund Policy
For standard online PeopleEvo subscriptions purchased through Paddle, Paddle acts as the Merchant of Record and processes applicable refund requests in accordance with the Paddle Refund Policy and applicable law.
Refund requests should be submitted within 14 days of the applicable transaction date for consideration under Paddle's discretionary refund process. Submission of a refund request within this period does not guarantee that a refund will be approved.
Where applicable law provides a statutory cancellation, withdrawal, or refund right, including a different time period or more favorable rights, those statutory rights apply and are not limited by this Refund Policy.
Except where required by applicable law or approved under Paddle's applicable refund process, transactions are non-refundable and non-exchangeable.
Nothing in this Refund Policy limits any mandatory consumer rights.
2. Subscription Cancellation
Customers may cancel a recurring PeopleEvo subscription using the cancellation options made available through PeopleEvo or Paddle.
Cancellation normally takes effect at the end of the current billing period and prevents the subscription from renewing for a further billing period.
Cancellation does not by itself constitute a refund request. Refund eligibility for amounts already charged is determined in accordance with Section 1 of this Refund Policy, Paddle's applicable refund procedures, and applicable law.
Cancellation does not itself constitute a request to immediately delete Customer Data. Access, account treatment, data retention, and deletion following cancellation remain subject to the PeopleEvo Terms and Conditions, Privacy Policy, and applicable subscription rules.
3. Renewal Charges
PeopleEvo subscriptions may renew automatically as described during purchase and in the PeopleEvo Terms and Conditions.
Refund requests relating to renewal transactions are handled in accordance with Section 1 of this Refund Policy, Paddle's applicable refund procedures, and applicable law.
If you believe a renewal was processed incorrectly or after a cancellation had already become effective, please contact PeopleEvo or Paddle support so that the transaction can be reviewed.
4. Subscription Changes
Eligible subscription changes, including plan upgrades, plan downgrades, employee-capacity increases or decreases, and billing-frequency changes, may take effect immediately.
Such changes may result in a prorated charge, account credit, tax adjustment, or no immediate external payment.
All applicable prorated amounts and related billing adjustments are calculated by our payment provider or Merchant of Record based on the subscription, applicable prices, timing of the change, billing period, taxes, credits, and other relevant transaction information.
PeopleEvo does not independently calculate or guarantee a particular prorated charge or credit before the payment provider has authoritatively determined the transaction.
Any refund request arising from a subscription change will be handled in accordance with Section 1 of this Refund Policy, Paddle's applicable procedures, and applicable law.
4.1 Account Credits
Certain subscription changes may result in an account credit rather than a cash refund.
An account credit is a billing adjustment maintained by the applicable payment provider or Merchant of Record and may be applied toward eligible future charges in accordance with that provider's applicable terms, policies, and procedures.
An account credit is not the same as money returned to the Customer's original payment method.
Cancellation of a PeopleEvo subscription does not by itself constitute a request to convert an unused account credit into a cash refund.
Any request concerning an unused account credit, including whether it may be refunded, adjusted, or otherwise treated, is subject to the applicable payment provider's procedures, this Refund Policy, applicable law, and any mandatory rights available to the Customer.
4.2 No Guaranteed Financial Direction
PeopleEvo does not guarantee that a particular type of subscription change will always result in a charge or always result in a credit.
The financial result depends on the payment provider's calculation at the time the change is processed.
For example, depending on the circumstances, a plan change, capacity change, or billing-frequency change may result in an additional amount due, an account credit, or no immediate external payment.
5. Duplicate, Incorrect, or Unauthorized Charges
If you believe you have been:
- charged more than once for the same transaction;
- charged an incorrect amount;
- charged after an effective cancellation;
- charged for a transaction you did not authorize; or
- otherwise charged in error,
please contact PeopleEvo support as soon as reasonably possible.
We may review:
- account records;
- subscription records;
- cancellation records;
- transaction references;
- payment-provider records; and
- other relevant information.
We may request reasonable information necessary to verify:
- the Customer;
- the account;
- the transaction;
- the authority of the requester; or
- the nature of the disputed charge.
Where we confirm that a charge was made in error, we will take appropriate steps to correct the transaction, which may include issuing or arranging a refund.
6. Exceptional Refund Requests
Refund requests for transactions processed by Paddle are reviewed and processed in accordance with Paddle's applicable refund procedures and applicable law.
Paddle may consider discretionary refund requests submitted within 14 days of the applicable transaction date. Submission within this period does not guarantee approval.
Where mandatory statutory refund, cancellation, or withdrawal rights apply, those rights remain unaffected.
PeopleEvo may assist customers with billing issues or provide relevant subscription and transaction information where necessary to support the review of a refund request.
7. Payment Provider and Merchant of Record
Standard online PeopleEvo subscription transactions are processed through Paddle, which acts as the Merchant of Record for those transactions.
As Merchant of Record, Paddle is responsible for functions including:
- payment processing;
- recurring billing;
- payment methods;
- invoices and transaction documentation;
- applicable transaction taxes;
- refunds;
- payment disputes; and
- related payment administration.
Payment information entered directly into Paddle's payment environment is processed by Paddle in accordance with its applicable terms, privacy practices, and payment-processing requirements.
For transactions processed through Paddle, refund requests and approved refunds are handled in accordance with:
- this Refund Policy;
- Paddle's applicable refund policy and procedures;
- applicable payment-method and card-network requirements; and
- applicable law.
Where a refund is approved for a transaction for which Paddle acts as Merchant of Record, the refund will be processed through Paddle. PeopleEvo does not independently return funds directly to the Customer for such transactions.
Customers may review Paddle's current refund terms and procedures through the Paddle Refund Policy.
Nothing in this section limits any refund, cancellation, withdrawal, consumer, or other rights that cannot legally be excluded or restricted.
8. Refund Method and Timing
Where a refund is approved for a transaction processed through Paddle, the refund will generally be returned to the original payment method where possible.
Paddle states that eligible refunds are processed within 14 days of approval. The time required for an approved refund to appear after processing may vary depending on factors such as:
- payment method;
- bank or card issuer;
- card network;
- currency;
- country;
- transaction status; and
- other financial-processing requirements.
Where the original payment method cannot be used, the refund may be processed using another method supported by Paddle in accordance with its applicable procedures.
PeopleEvo cannot guarantee the date on which an approved refund will appear in the Customer's account after Paddle has submitted it for processing.
Processing times or delays caused by Paddle, a bank, card issuer, card network, payment method, or other financial intermediary do not themselves create an additional refund or compensation obligation.
Nothing in this section limits any mandatory rights available to the Customer under applicable law.
9. Trials and Evaluation Access
PeopleEvo may offer:
- free trials;
- evaluation access;
- demonstrations;
- promotional access; or
- other limited-access arrangements.
Unless expressly stated otherwise, no subscription fee is charged solely for using a free trial until the Customer enters into a paid subscription or otherwise authorizes a charge.
Trial eligibility may be subject to reasonable anti-abuse restrictions based on factors such as:
- Customer organization;
- account;
- domain;
- prior trial use; or
- other reasonable eligibility criteria.
PeopleEvo may refuse, limit, or discontinue duplicate, fraudulent, or abusive trial registrations.
A trial does not create:
- an entitlement to continued free use;
- an entitlement to any particular paid plan;
- a guarantee that all paid features will be included in the trial; or
- a right to compensation if the trial offering is prospectively modified or discontinued.
Where a trial converts into a paid subscription, the applicable:
- pricing;
- billing period;
- renewal terms;
- employee capacity;
- feature entitlements; and
- other commercial terms
will be those presented as part of the applicable subscription process.
Customers are responsible for reviewing those terms before authorizing a paid subscription.
10. Suspension and Restricted Access
A Customer's access to PeopleEvo may be suspended, restricted, or terminated in circumstances described in the PeopleEvo Terms and Conditions, including where necessary in connection with payment status, unlawful or prohibited use, fraud or abuse, security concerns, or material violations of applicable terms.
Any refund request relating to a suspended, restricted, or terminated subscription will be handled in accordance with:
- Section 1 of this Refund Policy;
- Paddle's applicable refund policy and procedures, where Paddle processed the applicable transaction; and
- applicable law.
Suspension, restriction, or termination of access does not limit any refund, cancellation, withdrawal, consumer, or other rights that cannot legally be excluded or restricted.
11. Payment Disputes and Chargebacks
Initiating a payment dispute, card dispute, or chargeback does not itself constitute cancellation of a PeopleEvo subscription.
Customers should contact PeopleEvo or the applicable payment provider promptly if they believe a transaction is incorrect.
Where a transaction is disputed, PeopleEvo may, to the extent permitted by applicable law and the applicable payment-provider procedures:
- review the relevant account and transaction;
- provide transaction or subscription records to the payment provider;
- restrict or suspend the affected subscription while the dispute is being resolved; and
- take other reasonable steps to protect against fraud, duplicate recovery, or misuse.
A Customer is not entitled to receive both:
- a refund or other reimbursement for a transaction; and
- a successful chargeback or payment reversal covering the same amount.
Where duplicate reimbursement occurs, PeopleEvo may take reasonable steps to recover the duplicated amount.
12. Account and Data Retention
Cancellation, refund, payment dispute, or chargeback does not by itself constitute a request for immediate deletion of the Customer's PeopleEvo environment or Customer Data.
Account recovery, export, retention, backup, and deletion are governed by the PeopleEvo:
- Terms and Conditions;
- Privacy Policy; and
- applicable Data Processing Addendum.
Following subscription expiry or termination, Customer Data may remain subject to the applicable recovery period.
An authorized Customer administrator may request permanent deletion in accordance with the PeopleEvo deletion process.
Once Customer Data has been permanently deleted, PeopleEvo is not required to reconstruct or recreate that information.
13. Custom or Separately Agreed Commercial Arrangements
This Refund Policy applies to standard PeopleEvo online subscriptions purchased through Paddle.
PeopleEvo may separately offer custom or Enterprise arrangements subject to an individually negotiated written agreement. Such arrangements may involve custom pricing, capacity, implementation, migration, support, deployment, infrastructure, payment methods, or other commercial terms.
Where a custom or Enterprise arrangement is governed by a separate written agreement, the payment, cancellation, refund, credit, and other commercial terms of that agreement will apply to the extent permitted by applicable law.
Where Paddle acts as Merchant of Record for a custom or Enterprise transaction, Paddle's applicable buyer terms, refund procedures, and mandatory legal requirements will also apply.
14. How to Request a Refund or Report a Billing Issue
For transactions processed through Paddle, Customers may request a refund using the applicable options provided by Paddle, including through transaction or subscription information made available by Paddle or through Paddle Buyer Support.
Customers may also contact PeopleEvo through the available support or billing channels for assistance with a refund request, billing issue, or transaction inquiry.
Refund requests should be submitted within 14 days of the applicable transaction date for consideration under Paddle's discretionary refund process. Submission of a request within this period does not guarantee that a refund will be approved.
Where applicable law provides the Customer with statutory cancellation, withdrawal, refund, or other rights, including a different time period or more favorable rights, those statutory rights remain unaffected.
When contacting PeopleEvo regarding a refund or billing issue, please provide sufficient information for us to identify and review the relevant transaction, such as:
- Customer organization name;
- email address associated with the PeopleEvo account;
- relevant invoice or transaction reference, where available;
- date or approximate date of the charge; and
- a brief explanation of the issue.
We may request additional information where reasonably necessary to verify:
- the Customer;
- the account;
- the transaction;
- the authority of the requester; or
- the nature of the billing issue.
Do not send complete payment-card information, card security codes, passwords, authentication codes, or other sensitive authentication credentials through:
- email;
- support tickets;
- chat;
- contact forms; or
- other PeopleEvo communication channels.
Where Paddle acts as Merchant of Record, final processing of an approved refund is performed through Paddle in accordance with Paddle's applicable procedures.
Nothing in this section limits any mandatory consumer rights available under applicable law.
15. Changes to This Refund Policy
We may update this Refund Policy periodically to reflect changes to:
- PeopleEvo;
- our subscription model;
- payment arrangements;
- payment providers;
- legal requirements; or
- business practices.
When we make material changes, we will update the Effective Date and may provide additional notice where appropriate.
Changes will not limit refund or cancellation rights that cannot legally be restricted.
